Terms of Service

These Terms of Service (“Terms”) form a binding
agreement between you (“you” or “user”)
and Westbridge Technologies, the sole proprietorship that operates SystemDesign.so
(“SystemDesign.so,” “we,”
“us,” or “our”) governing your access
to and use of the websites, web applications, APIs, and services we make
available at systemdesign.so and app.systemdesign.so
(collectively, the “Service”).
SystemDesign.so is operated by Westbridge Technologies, a sole proprietorship registered in India.
By creating an account, clicking a button indicating acceptance, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the Service.
Arbitration notice. Section 14 contains a binding individual arbitration agreement and a class-action waiver that affect your legal rights. Please read it carefully.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of entering into a binding contract to use the Service. By using the Service you represent that you meet these requirements and that you are not barred from receiving the Service under any applicable law. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
2. Your Account
To use most features of the Service you must create an account. You agree to provide accurate and complete information, to keep it current, and to keep your credentials confidential. You are responsible for all activity that occurs under your account, including activity by anyone you authorize. You agree to notify us promptly at support@systemdesign.so if you suspect unauthorized access. We may suspend or terminate your account if we believe it has been compromised or used in violation of these Terms.
3. Description of the Service
SystemDesign.so provides an AI-driven interactive interviewer for technical interview practice, including but not limited to system-design questions. The Service may transcribe your voice in real time, respond to you with synthesized speech, generate written feedback and scores, and produce post-interview reports. The Service is provided for practice, study, and self-evaluation only.
Not professional advice; not a guarantee of employment. Output generated by the Service is informational and probabilistic. It is not professional career, legal, financial, or other advice, does not constitute hiring decisions by any third party, and does not guarantee any particular interview, offer, or employment outcome.
4. License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use. All rights not expressly granted are reserved by SystemDesign.so.
5. Acceptable Use
You agree not to, and not to attempt to:
- Use the Service to violate any law, regulation, or third-party right, including intellectual-property, privacy, or publicity rights.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, models, weights, prompts, or underlying algorithms of the Service, except to the extent applicable law expressly prohibits this restriction.
- Scrape, crawl, harvest, or copy substantial portions of the Service, or use any automated means to access the Service in a manner that imposes an unreasonable load on our infrastructure.
- Use the Service or its output to develop, train, fine-tune, or evaluate any competing artificial intelligence, machine-learning, or large-language model, or to provide a substantially similar service to third parties.
- Resell, sublicense, or otherwise commercially exploit the Service or any credits, accounts, or output, except as expressly permitted by us in writing.
- Share, transfer, or pool a single account among multiple individuals; accounts are personal to a single user.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, other accounts, or any computer system or network connected to the Service.
- Submit content that is unlawful, defamatory, harassing, hateful, sexually explicit, violent, deceptive, infringing, or harmful, including content that contains malware or that you do not have the right to submit.
- Use the Service to make decisions about other individuals that produce legal or similarly significant effects on them (for example, employment, credit, housing, or insurance decisions).
6. User Content and Submissions
“User Content” means anything you submit to the Service, including but not limited to your typed text, diagrams, drawings, canvas state, voice recordings, transcripts of your spoken answers, notes, and any other materials you upload or generate while using the Service.
You retain ownership of your User Content. You grant SystemDesign.so a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, display, and create derivative works of your User Content solely as necessary to (a) provide, secure, debug, and improve the Service for you, (b) generate the interview output and reports you request, and (c) comply with law. We do not sell your User Content, and we do not use the substance of your individual interview answers (your audio, transcripts, diagrams, or notes) to train foundation models for third parties. Aggregated and de-identified analytics that cannot reasonably be used to re-identify you may be used to operate and improve the Service.
You represent and warrant that you have all rights necessary to grant the license above and that your User Content does not violate these Terms or any third-party right.
7. AI-Generated Output
The Service uses large language models and other machine-learning systems to generate output (“Output”). Subject to your compliance with these Terms, as between you and SystemDesign.so, you own the Output generated for you, except for portions of the Output that consist of SystemDesign.so’s own proprietary content (such as our scoring rubrics, question stems, evaluation criteria, and report templates).
Output is generated probabilistically and may be inaccurate, incomplete, offensive, or otherwise unsuitable. You should independently verify Output before relying on it. Output is not professional advice. Similar or identical Output may be generated for other users; you acknowledge that Output may not be unique to you.
8. Plans, Credits, Billing, and Refunds
The Service is offered on free and paid plans. Paid features may be accessed through a subscription, a one-time credit purchase, or both. Plans, credit allotments, and prices are described on the pricing page and at checkout.
Payments are processed by our merchant of record, whose own terms apply to the payment transaction. Your purchase is made through a third-party merchant of record, which acts as the seller of record for the transaction; the merchant of record’s business name and contact details appear on your receipt and invoice. You authorize us and our payment processor to charge your selected payment method for all applicable fees, taxes, and other amounts. Subscriptions automatically renew at the end of each billing period at the then-current rate until cancelled. You may cancel a subscription at any time from your account settings; the cancellation takes effect at the end of the current billing period.
Credits. Interview credits are consumed when you start an interview session as described at checkout, and expire at the end of the billing period or other expiration window disclosed when the credits were granted. Unused credits do not roll over unless explicitly stated. Except for the refund cases described in our Refunds & Cancellations policy, and except where required by law, credits are non-refundable once purchased.
Refunds. We want you to be satisfied with the Service. If you are charged in error, accidentally or twice, you may request a refund within 14 days of the charge by contacting support@systemdesign.so. Full details, including how to request a refund and how cancellations work, are in our Refunds & Cancellations policy. Outside the cases described there, and except where required by law, payments are generally non-refundable. If you are a consumer in the EU, EEA, or UK, you have a statutory 14-day right of withdrawal; because we make credits and session minutes available immediately, you ask us to begin performance at once and acknowledge at checkout that this right ends once you begin using the credits or session minutes you purchased. We may decline or reverse refunds we reasonably believe to be fraudulent or abusive. The refund policy of our merchant of record also applies to the payment transaction.
Price changes. We may change prices at any time. Changes take effect at the start of your next billing period after notice.
9. Intellectual Property
The Service, including all software, models, prompts, designs, text, graphics, logos, question banks, scoring rubrics, and other content provided by SystemDesign.so (collectively, the “SystemDesign.so IP”), is owned by SystemDesign.so and its licensors and is protected by applicable Indian and international intellectual-property laws. Except for the limited license granted in Section 4, no rights in the SystemDesign.so IP are granted to you. “SystemDesign.so” and our logos are trademarks of SystemDesign.so; you may not use them without our prior written permission.
10. Feedback
If you send us feedback, ideas, or suggestions about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use that feedback for any purpose without obligation to you.
11. Third-Party Services
The Service relies on third-party providers, including but not limited to cloud hosting (Amazon Web Services), payment processing, speech-to-text providers (such as Deepgram), large-language-model providers (such as Anthropic and OpenAI), email delivery, and analytics (such as PostHog). Your use of those providers’ services through the Service is governed by their own terms and privacy policies. We are not responsible for third-party services beyond what is described in our Privacy Policy.
12. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, SYSTEMDESIGN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SYSTEMDESIGN OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR FOR ANY EMPLOYMENT OR INTERVIEW OUTCOME, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THE LIMITATIONS IN THIS SECTION APPLY TO EVERY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
14. Dispute Resolution; Binding Arbitration; Class Waiver
Informal resolution. Before bringing a formal claim, you agree to first contact us at legal@systemdesign.so and try in good faith to resolve the dispute for at least 60 days.
Binding arbitration. If we cannot resolve the dispute informally, you and SystemDesign.so agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration conducted under the Arbitration and Conciliation Act, 1996 of India. The seat and venue of arbitration will be Haryana, India, and the arbitration may be conducted by videoconference. The proceedings will be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction in India.
Class action waiver. You and SystemDesign.so agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate or join claims of more than one person.
Exceptions. Either party may bring (i) an individual action in small-claims court, and (ii) an action seeking injunctive or other equitable relief to protect intellectual-property rights, in a court of competent jurisdiction.
30-day opt-out. You may opt out of the arbitration and class-waiver provisions of this Section 14 by emailing legal@systemdesign.so within 30 days of first accepting these Terms with the subject “Arbitration Opt-Out” and your account email.
15. Governing Law and Venue
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Subject to Section 14, the courts located in Haryana, India have exclusive jurisdiction over any action not subject to arbitration, and you consent to the personal jurisdiction of those courts.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SystemDesign.so and its affiliates, officers, employees, agents, suppliers, and licensors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) your User Content, (c) your violation of these Terms or applicable law, or (d) your violation of any third-party right.
17. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Service or other users. You may stop using the Service and delete your account at any time. Upon termination, the rights granted to you under these Terms will end and we may delete your User Content as described in our Privacy Policy. Sections that by their nature should survive termination (including Sections 6, 7, 9, 10, 12, 13, 14, 15, 16, and 18) will survive.
18. Changes to the Service or Terms
We may modify or discontinue the Service, or any part of it, at any time. We may also update these Terms from time to time. If we make material changes, we will provide reasonable advance notice (for example, by email or in-product notice). Changes become effective on the date stated in the notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
19. Export and Sanctions Compliance
You may not use, export, or re-export the Service in violation of any applicable export-control or economic-sanctions laws, including those of India and any other jurisdiction that applies to you. You represent that you are not located in, and are not a national or resident of, any country or on any list to which such laws prohibit the supply of the Service.
20. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and SystemDesign.so regarding the Service and supersede any prior agreements on that subject. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them freely. Notices to you may be provided by email or in the Service. Notices to us must be sent to legal@systemdesign.so.
